The Presidents Statement on Government Shutdown

 Okay boys and girls. I caught a little bit of this bit of sophistry this afternoon. If I hadn't been trying to cook supper at the time so got a grip on my temper...I might be sans TV right now. Okay that and I REALLY don't want to have to shell out for a new television when my excuse would be "the presidents duplicitous deceitfulness and stupidity made me do something stupid.

Anyway my fisking will be interspersed and in bold. Let the fscking commence.....

THE PRESIDENT:  Good afternoon, everybody.  Of all the responsibilities the Constitution endows to Congress, two should be fairly simple:  pass a budget, and pay America’s bills.

Yep and you and the dem majority haven't managed to do the first since you and the dems won in 08.  Hell you couldn't even be bothered to pass a budget when you had complete control of both fucking  houses!  Nope...too busy ramming a bill down our throats in the dead of night that gives the government access and control over one of the largest portions of our economy. Medical care.

But if the United States Congress does not fulfill its responsibility to pass a budget today, much of the United States government will be forced to shut down tomorrow.  And I want to be very clear about what that shutdown would mean -- what will remain open and what will not.

Again...congress has done nothing but pass "Continuing Resolutions" which allow you to keep spending at current levels without any accountability since your rise to power. 

With regard to operations that will continue:  If you’re on Social Security, you will keep receiving your checks.  If you’re on Medicare, your doctor will still see you.  Everyone’s mail will still be delivered.  And government operations related to national security or public safety will go on.  Our troops will continue to serve with skill, honor, and courage.  Air traffic controllers, prison guards, those who are with border control -- our Border Patrol will remain on their posts, but their paychecks will be delayed until the government reopens.  NASA will shut down almost entirely, but Mission Control will remain open to support the astronauts serving on the Space Station.

Really? All these things will remain open? Does that include NSA, CIA, FBI, IRS etc etc?  If so then the government isn't completely shut down is it?

 I also want to be very clear about what would change.  Office buildings would close.  Paychecks would be delayed.  Vital services that seniors and veterans, women and children, businesses and our economy depend on would be hamstrung.  Business owners would see delays in raising capital, seeking infrastructure permits, or rebuilding after Hurricane Sandy.  Veterans who’ve sacrificed for their country will find their support centers unstaffed.  Tourists will find every one of America’s national parks and monuments, from Yosemite to the Smithsonian to the Statue of Liberty, immediately closed.  And of course, the communities and small businesses that rely on these national treasures for their livelihoods will be out of customers and out of luck.

Sorry but the parks aren't critical are they? Sure they bring in tourist dollars to the parks and surrounding communities but critical to government operation? Nah...don't think so.  Why would business owners see delays in raising capital oh great one?  Since they can get that capital from their fellow free citizens in private industry?  Permits?  Permits are nothing more than a means to extort yet MORE money from folks who already pay too much in taxes.   Rebuilding after a hurricane sucks but they didn't take anywhere NEAR the damage up north that we took here in the south from say....Katrinaa[and there was a lot of unnecessary and unprosecuted graft there wasn't there?] and Ike.  Sorry I feel for the people affected but by and large the people down here picked themselves up by their bootstraps and rebuilt on their own.

And in keeping with the broad ramifications of a shutdown, I think it’s important that everybody understand the federal government is America’s largest employer.  More than 2 million civilian workers and 1.4 million active-duty military serve in all 50 states and all around the world.  In the event of a government shutdown, hundreds of thousands of these dedicated public servants who stay on the job will do so without pay -- and several hundred thousand more will be immediately and indefinitely furloughed without pay.

Yes lets talk about that?  WHY is the federal government the largest employer?  Our forefathers did NOT create this nation to have a government be the largest employer They BUILT it so free thinking, intelligent FREE citizens could build their OWN businesses and employ each other with minimal interference from the government.  Or be self employed, again building a business with minimal interference from the government.   The government, the massive number of citizens be DAMNED...was never intended to be the overarching, overreaching overbearing monstrosity that it is now.  And that Bill I mentioned that got rammed through in the middle of the night most didn't want? The ACA?  Will create 10's of thousands...some say HUNDREDS of thousands of more positions within the government. 16000 in the IRS alone. What. The. Fuck?!

What, of course, will not be furloughed are the bills that they have to pay -- their mortgages, their tuition payments, their car notes.  These Americans are our neighbors.  Their kids go to our schools.  They worship where we do.  They serve their country with pride.  They are the customers of every business in this country.  And they would be hurt greatly, and as a consequence, all of us will be hurt greatly, should Congress choose to shut the people’s government down.

Yes those who work for the government will be hurt....but most of the REST of america, outside of those on the dole have been hurting for YEARS.

So a shutdown will have a very real economic impact on real people, right away.  Past shutdowns have disrupted the economy significantly.  This one would, too.  It would throw a wrench into the gears of our economy at a time when those gears have gained some traction.

Gained traction? ROFLOLOLOL

Five years ago right now, our economy was in meltdown.  Today, our businesses have created 7.5 million new jobs over the past three and a half years.  The housing market is healing and our deficits are falling fast.  The idea of putting the American people’s hard-earned progress at risk is the height of irresponsibility. 
And it doesn’t have to happen.  Let me repeat this:  It does not have to happen.  All of this is entirely preventable if the House chooses to do what the Senate has already done -- and that’s the simple act of funding our government without making extraneous and controversial demands in the process, the same way other Congresses have for more than 200 years.

Anyone ever notice that when someone objects to what the president, the rest of the dems and their lackeys want to's controversial? It's extreme?  It's unreasonable?  It's UnAmerican? Or any other descriptive you care to name? 

Unfortunately, right now House Republicans continue to tie funding of the government to ideological demands like limiting a woman’s access to contraception, or delaying the Affordable Care Act, all to save face after making some impossible promises to the extreme right wing of their party.

Ahh now we're going from extraneous and controversial, to ideological demands  to saving face and extreme right wing.    Extreme when the republicans presented and passed a budget that would fund EVERY facet of the government monstrosity EXCEPT for ACA?

So let me be clear about this.  An important part of the Affordable Care Act takes effect tomorrow no matter what Congress decides to do today.  The Affordable Care Act is moving forward. That funding is already in place.  You can’t shut it down.  This is a law that passed both houses of Congress; a law that bears my signature; a law that the Supreme Court upheld as constitutional; a law that voters chose not to repeal last November; a law that is already providing benefits to millions of Americans in the form of young people staying on their parents’ plan until they’re 26, seniors getting cheaper prescription drugs, making sure that insurance companies aren't imposing lifetime limits when you already have health insurance, providing rebates for consumers when insurance companies are spending too much money on overhead instead of health care.

Yeah that one seems to tell a DIFFERENT story doesn't it? that one company after an income for 60 some million paid out $48 million of that in claims and medical expenses of its customers to doctors, labs, hospitals etc.

Those things are already happening.
Starting tomorrow, tens of millions of Americans will be able to visit to shop for affordable health care coverage.  So Americans who’ve lived for years in some cases with the fear that one illness could send them into bankruptcy, Americans who’ve been priced out of the market just because they’ve been sick once, they’ll finally be able to afford coverage -- quality coverage -- many of them for the first time in their lives.

Here's one that never gets discussed. What about those us who are basically healthy and never saw the NEED to shell out for health insurance?  See I'm of the mind that health insurance should not cover every single fucking thing.  Drugs? Okay cover part of that maybe especially some of the more expensive mother fuckers that cost several hundred dollars a month for just a one month supply of ONE drug. The other side of the coin is the PHARMA companies offer deals and help in that regard. Besides do you have any idea what it costs the Pharma companies to get just ONE goddamn drug to market and how many years of research, testing and jumping through government hoops they have to go through to get it to market?

Here's one article and no you aren't hallucinating..a DECADE  minimum goes into getting just ONE drug to market.
However lets go back to those that don't see the point in the ME.
  I visit the doctor on average maybe ONCE a year. that's not for a check up either.  It's generally when my allergies flare up something awful and I have to go in and get a new script anyway for my nasal inhaler, and now bronchial inhaler for intermittent bronchitis.  That's it.  So why am I going to spend upwards of $12-15000 a year I could put to better use elsewhere for coverage I don't see a point to.  Now if offered the option I might do a plan now that I'm getting older, a plan that offers catastrophic coverage for hospital visits and doesn't cover my drugs or doctors visits.  That I might do. Outside of that?  No, hell no.

Some of them may be sick as we speak.  And this is their best opportunity to get some security and some relief.  Tens of thousands of Americans die every single year because they don’t have access to affordable health care.  Despite this, Republicans have said that if we lock these Americans out of affordable health care for one more year -- if we sacrifice the health care of millions of Americans -- then they’ll fund the government for a couple more months.  Does anybody truly believe that we won’t have this fight again in a couple more months?  Even at Christmas?

Wait, what's this 'don't have access to healthcare' shit?   You can go to the hospital if your sick and they will see you. You can even, if you're broke, appeal to the hospital board for hardship cases and the hospital will waive the fees if the board approves.  It can be done, I've SEEN it done.    So sell that particular pile of shit to someone who believes a single word that comes out of your mouth.

So here’s the bottom line:  I’m always willing to work with anyone of either party to make sure the Affordable Care Act works better, to make sure our government works better.  I’m always willing to work with anyone to grow our economy faster, or to create new jobs faster, to get our fiscal house in order for the long run.  I’ve demonstrated this time and time again, oftentimes to the consternation of my own party.

Willing to work with? Seems to me that anytime the other side comes to the table they always go home sorry and sore and it's your way or the highway.

 But one faction of one party, in one house of Congress, in one branch of government doesn’t get to shut down the entire government just to refight the results of an election.

YES actually they DO. See the HOUSE controls the nations purse strings; NOT you and NOT the senate.  The HOUSE is the nations minder of the checkbook and dispenser of funds...if they don't let the funds go out...whatever pet project your pandering to the profuse number of sheep out there to, doesn't get funded.  The house is...for lack of a better analogy...the economic advisor to the PEOPLE. An executor if you will.   Wait...I got it. The HOUSE holds a Power of Attorney from the people, giving them financial responsibility and control over the REST of the government. The HOUSE in effect gets to...tell the rest of the government where to shove it, when the funds are lacking. The house has quite frankly been failing miserably in this regard for not just as long as the Second Coming of JFK has been in the white house but for more than a decade.  However the failure has been exceedingly egregious over the last 5yrs. Not entirely the fault of the minority party either, though they certainly bear a portion of the blame.   Understand now germs and virii?

Keeping the people’s government open is not a concession to me.  Keeping vital services running and hundreds of thousands of Americans on the job is not something you “give” to the other side.  It’s our basic responsibility.  It’s something that we’re doing for our military, and our businesses, and our economy, and all the hardworking people out there -- the person working for the Agricultural Department out in some rural community who’s out there helping some farmers make sure that they’re making some modest profit for all the hard work they’re putting in.  They’re the person working for HUD who’s helping somebody buy a house for the first time.  They’re somebody in a VA office who’s counseling one of our vets who’s got PTSD.

There you go again using strawmen, and emotional bullying to try and bulldozer over logical thought.  Dude seriously?  You are starting to bore the hell out of me. Put a zipper on your lips, zip them shut and then have someone come behind and weld that zipper shut. I'm tired of seeing your lips move and hearing the grating annoyance of your lying voice.

That’s who we’re here to serve.  That’s why we’re supposed to be carrying out these responsibilities.  It’s why we should be avoiding these kinds of constant brinksmanship.  It’s something that we do in the ordinary process of this extraordinary system of government that we have.  You don’t get to extract a ransom for doing your job; for doing what you’re supposed to be doing anyway; or just because there’s a law there that you don’t like.

You aren't here to serve any but your own interests. You proved THAT one with the ACA. You've proved that one with some of the regulations that have come down at your direction, or those of your functionaries, from various agencies like the EPA...just to name one, the ATF for another.  the only time you SEE the people is when you look down to see what it is  you're stepping on.

The American people sent us here to govern.  They sent us here to make sure that we’re doing everything we can to make their lives a little bit better -- to create new jobs, to restore economic security, to rebuild the prospects of upward mobility.  That’s what they expect.

No we sent you there to mind the store and then turn it over to the NEXT manager we hire and move the fuck on.   Yet you and those like you...especially in congress...seem to have forgotten that.  Otherwise there wouldn't be people in the house and senate that have been there as long as I've been ALIVE. There also wouldn't have been seats held for 50-80 YEARS by political DYNASTIES, iow held by the same FAMILIES for multiple generations. That is NOT what our forefathers intended, you and those before that have been corrupting those intentions for decades, some of my friends would say for well over a century.

And they understand that there are differences between the parties and we’re going to be having some tough fights around those differences.  And I respect the fact that the other party is not supposed to agree with me 100 percent of the time, just like I don’t agree with them.  But they do also expect that we don’t bring the entire government to a halt or the entire economy to a halt just because of those differences.

What I understand is those with you are either your contemporaries and only interested in power and control, or your sheepish servants who seem to CRAVE the slave chain;  because acting on their own and exercising not only their constitutional rights,  but personal responsibility, scares the ever loving hell out of them.

That’s what they deserve.  They’ve worked too hard, for too long to recover from previous crises just to have folks here in Washington manufacture yet another one that they have to dig themselves out of. 
So Congress needs to keep our government open, needs to pay our bills on time, and never, ever threaten the full faith and credit of the United States of America. 
And time is running out.  My hope and expectation is that in the eleventh hour, once again, that Congress will choose to do the right thing and that the House of Representatives, in particular, will choose the right thing.

No what we deserve is a government that stays the hell out our way.   My friend Ev read an article some time back that states that there has been so many laws and regulations passed in recent years; that your average american commits 3 felonies a day because he doesn't even know they exist.  Ev...if you still have the link feel free to paste it in the comments old friend.

Now lets move on to "Congress will choose to do the right thing and that the house of reps in particular will choose the right thing"  Uhmm they already HAVE chosen the right thing.

However.... in this context germs and virii what the right thing to do is by his to shut the fuck up, sit the down and do what you are damn well told.  Sorry...I ain't built that way.
Like Captain Mal from least SOME of those up in DC seem to be of the same mindset as me.  In that they aim to misbehave.  I applaud them for it.

Programming note

I'm going to be away from my own computer for the next day, possibly 3. I will most likely still read your responses. I may not respond to them for a day or 4 though. Just so you are duly forewarned my germs and virii. :)

Are we any longer worthy?

Worthy of the legacy our forefathers created and left for us? This is the question that is rolling around in my mind right now. It hit me a little earlier this afternoon...and I've been pontificating on it ever since.  Why?  Here's 3 reasons. Perpend

1. The ACA aka Obamacare. A bureaucratic, job destroying clusterfuck of a nightmare. A bureaucratic job destroying clusterfuck of a nightmare that was rammed down our throats in the middle of the night strictly by the democrat party because no one else in their right mind would VOTE for the damn thing.  Oh and...Job Destroying that is unless your employer is or is soon to be the federal government. Under the ACA there will be 10's of thousands of new government jobs created. 16,000 alone at the IRS to enforce this clusterfuck and make sure people who aren't ON some sort of health insurance a fine along with their taxes...upwards of $2,000/yr for the next couple years, if I remember correctly.  After which point you can almost assuredly expect the cost of that fine to go up...mark my words.

Yesterday Ted Cruz started a filibuster which the snide are deriding and those in power are calling a waste of time to try and get the funding resolution he supports; which will fund every sector of government except Obamacare passed and educate the people a little bit.

2. We have Justices in their official opinions on a 5th amendment case referring to our constitutionally enumerated and protected rights, as privileges.     

will simply say that, the minute you allow the courts to redefine your rights as are farther down that path to fully screwed...and further down the path to communism or outright dictatorship, than I care to contemplate.  One more nail in the coffin of the legacy our forefathers left for us.  This one should scare the shit out of everybody.   No matter which side of the political aisle you fall on.  Sadly it's been lost in the shuffle. The pundits and "press" and 'we the people'  should have been raising such a hue and cry over this one that it should have shaken the very foundation and rafters of the US Supreme Court Building and brought it tumbling down on the justices heads!

3. Furthermore I hear this one today...

I have so many problems with this one I don't even know where to start. but let me enumerate one or two.
Are we, or are we NOT a sovereign nation.  Because if we are...what the hell are we doing signing a treaty that would enforce regulation imposed upon us from outside, by countries that at best, don't like us much and at worst..hate us passionately and would see us destroyed?

2. This travesty has to be ratified by 2/3's of the senate.  The full senate I believe which means 2/3's of all 100 sitting senators. Which means 67 senators. Which means that... of the 46 republicans in the senate 13 would have to spit on the constitution and wipe their asses with it. Which is what they'd be doing. Yeah yeah most of DC has been doing that for decades I know but this one is beyond the pale. Which means for my's not THAT likely.  I hope I'm right on that bet..I really do.

So if it ain't likely to be ratified then, what are the odds that Obama is going this route to distract us from the budget fight[what fucking budget...they haven't bothered to pass a budget in 5 goddamn years!] and Obamacare and various other scandals and end runs around the constitution. All perpetrated upon us by this administration and it's minions in the congress?

The long and the short of it is, it would allow a national registry. If I'm reading what I'm seeing in the text on a skim through, it requires it.  Remember,  registry is the first step towards confiscation.

2b. So if it doesn't get past the senate, what are the odds  he will still try and implement it section by section via fiat, by executive order?  As he's shown in recent years he really doesn't care what we think,  neither does most of congress.

Honestly?  I said before, I believe I have an inkling of whats coming. Again..I don't like it one goddamn bit.

So again, I'll posit the question...Are we any longer worthy of the legacy our founding fathers left us?
Honestly?  To my mind, as it regards most people in DC, and in the state houses and city councils all over this nation?  The answer is, with a few exceptions, not even fucking close.

As it regards We the People?     Court is still in session but the gavel  will be coming down soon and we are our own jury.  .

So think deep and long my fellow jurists and choose wisely.

The Filibuster of yet another CR.

Senator Ted Cruz has been speaking more or less continually since about 130pm my time[central] yesterday. The vitriol I've seen displayed, the snide comments I've seen about it, are disheartening.

The media quite frankly I expect it from. they are owned lock stock and both smoking barrels, complicit and willingly in league with the democrat party. Hence why some time ago I renamed them the Progressive Propaganda Ministry.

Now I missed the first two of those things...but...I happen to LIKE the story green eggs and ham still to this day.  So bite me.    As for White Castle...he was pointing to the stated fact, stated BY White Castle,  that White Castle was cutting back on their store openings,because under ACA they could no longer AFFORD to build those stores and more importantly HIRE the staff to man/run them!

Okay let me stop right here to respond to that last one. What?  And Obama never doing anything except by teleprompter is any better?


God there are so many tweets it's hard to get em all. That being said... Let me finish this as I listen to Ted Cruz finish out his last 30 mins, unless the majority gives him consent to continue, which I seriously doubt.;  that Filibusters be they "true" filibusters that happen on the day of a major or minor bill vote or pre or post cloture votes...don't happen often. They are the last resort in this day and age of instant communcations to TRY and educate, elucidate and illumate people on just what it is these bills are about.   To try and change minds if possible.  Now again in this day and age when the divisions of ideals are so wide, so set in stone this isn't likely...but it is possible.   

To....demean this process, these filibusters be they a "true" filibuster during the time the congress is supposed to be voting on  a bill or pre or post cloture floor time to spit upon the people, to spit upon the memories of those who have gone before these politicians, those that filibustered themselves in the past. Whether I agree with the reasons behind those filibusters or demean THIS filibuster and Senator Ted Cruz, the man currently in control of the floor.  It spits upon the memories and accomplishments of the founders of our country and those that came after, and those among the rest of us that weren't in DC; WE THE PEOPLE.

When WE The People abrogate our responsibilities and yield up the power to the government as has been happening for decades...we demean the memories of our fore fathers.   I haven't bothered to even try and discuss this with anyone because in once case it's by and large preaching to the choir and on the other?  The other is childish folk sticking their fingers in their ears and humming REAL loud.

I believe I inkling what our future holds. Immediate and slightly farther out. I don't like it. I don't like it one damn bit.

And it's over. Sen Cruz is finished as per senate rules. personally I think it was petty for Reid to NOT allow Sen Cruz to proceed until he dropped.  Now they are invoking a prayer. A prayer that for my money I believe falls upon deaf ears. I believe a great many of those on the hill worship one thing..POWER.

Now Reid is insulting and spitting upon Sen Cruz, the american people and the memories of our forefathers, by calling Sen Cruz filibuster a waste of time.  weep for the future.

American Gun Use is OUT of Control!

Oh noes whatever shall we do?  Shall we cower and simper?  I think not. Lets just call on the UN and the rest of the worlds NGO's all of whom hate disarm the american people.  My response to this thought line?  I hope you've made out your will....

If you are going to complain about the violence I'm surprised this idiot didn't use stock footage of swat armed cops, or even your average regular department cops many of whom have AR-15's as standard equipment. Sigh...the man in that photo is most assuredly not ON the range.  He might be AT the range in the gun shop, but he's not ON the range.

Lets take the quote....You are including suicides in those numbers laughing boy. I don't. and your numbers for those killed in WARS is off anyway.
By my count it's more like 1.25 million americans killed in all wars since the civil war, just in KIA 620,000 of those ALONE was the civil war. and since you insist on including SUICIDES in your numbers..I'll include casualties/injured and MIA's in MINE. Which brings the numbers for the Civil War alone up to 1.5 MILLION people. That right there by itself, that single war, trumps your 1.384 million killed by guns in the US by.....115,829 people.

Hmmm. I gotta wonder at those numbers. Be they true or not know this.  People like you bemoan the deaths in America and curse gun owners and point to yourselves as though you were better.  Here's a newsflash again.   Do you people know what the ACTUAL percentage of people killed/murdered in the US are? Not the per capita numbers used by the PPM to inflate, conflate and bullshit the american people? You should...I've posted the goddamn numbers often enough. The actual percentage of the US population that is murdered every year is less than one percent. The numbers are invariably between 5 and 9 THOUSANDTHS of ONE percent of the total population. That's right the numbers are between .005-.009% of 1% of the US population being murdered every year.  THAT's it.  Now again do ya'll know how the reports are compiled?  In the US any murder investigated or suspected as such, whether there's a court conviction or not...goes into the US numbers. Short short rant on illegal drugs/war on same

Saw a post on facebook a while ago that showed an infographic on war on drugs, and cost.  It was headed by several things including "victimless crime."

Now while I agree by and large that it's a STUPID war and costs us a shit ton of money for no gain..I take exception to the "it's a victimless crime" shit. I knew at one time plenty of people who used pot...which comprise the bulk of the drug users in the nation, about 95%% give or take. They tend to be, least the ones I knew in the past...successful business owners, and tech wiz kids who run networks for big companies.  Where I take exception to victimless crime bullshit is with the hardcore users of hallucinogens, inhalants, heroin and others comprise about 3.5 million of the nation's 22-23 million users. Those who use those drugs tend to be the real problem children, committing robberies and murders, and car jackings and shit to get their next fix.  So do NOT tell me the drug business is victimless you assholes.

Historical, and not in a good way, USSC decision

Ladies and gents...apparently while we've all been busy focusing on President Obummer, the congress, the various government agencies and how THEY are trying to fuck us....
Repeated multiple attempts and and infringements on our 2nd amendment rights since 1934 on the federal level. the stuff they've been doing on state levels in certain states is seriously heinous.
Attempts to regulate us into virtual and financial slavery....the clusterfuck known as Obamacare, EPA regulations, OSHA regulations.  New rules and regs up and down the government bureaucracy alphabet soup. 

We kind of forgot to watch the United States Supreme Court.

In a decision this language that leaves me cold...the dishonorable justices termed our constitutionally protected rights...well just one for now, as privileges.  No I shit you not.  In Salinas V. Texas  the supremes...inluding Justices, Scalia, Kennedy,  Thomas, Alito.etc, all..said the plaintiffs case failed to meet requirement for the 5th amendment.  Justice Alito went so far as to say, and Justices Kennedy and Chief Justice Roberts agreed that,
KENNEDY,concluded that petitioner’s Fifth Amendment claim fails because he did not expressly invoke the privilege in response to the officer’s question

Wait...what?  Since WHEN did our constitutionally enumerated and protected RIGHTS become privileges?    Here's a kicker...the only justice to file a dissenting opinion in this case was Breyer.

Now without a singular doubt the plaintiff[suspect] should have exercise his right to shut the fuck up to avoid self incrimination just a tad sooner. But at the time of his questioning, he wasn't under arrest, he wasn't mirandized, he was cooperating with officers. up til they got to the point where they asked him if the shells found at the crime scene would match his shotgun. THEN he shut up.  Read the file.  It's interesting. He wouldn't answer that one simple question but cooperated with every other single question the PD asked.  Hell they lacked sufficient evidence to arrest him for it in the first place so they arrested him for outstanding traffic warrants to his name. He was released due to insufficient evidence to even attempt to try him for murder. They arrested him on hearsay "witness" evidence in which someone else said they heard Salinas confess to the murders.

Justice Alito went on to say in his opinion that "The privilege against self incrimination is an exception to the general principle that the government has a right to everyones testimony"

Justice Breyer wrote and Justices Kagan, Ginsburg and Sotomayor joined him..
"In my view the fifth amendment here prohibits the prosecution from commenting on the petitioners silence in response to police questioning. And I dissent from the courts contrary conclusion"

A friend of mine upon reading this story on my facebook wall said...and I quote  "if the amendments can be classified as privilege, then think of the 1st, 2nd, and 4th and how they come into play. In short as a country, you are screwed if this is allowed to continue"In short I happen to agree with him. Although he's leaving out the 6th. 8th  and frankly the government on all levels has been ignoring and pissing all over  the 10th for  decades if not longer. If we allow the courts to redefine our constitutionally protected rights as privilege, then we are dead as a nation. Dead and buried and all over but the dying and enslavement of the people.  So the question becomes...what happens, what do we do going forward? 

In the long....

There are it is said 4 boxes of liberty.  First is The Soap Box ,in which we speak our minds and try to enlighten others as to what we think and why we think and try to bring them around to thinking as we do through logical, reasoned and sometimes highly impassioned  argument.

Sadly a great many aren't listening to logical argument backed by historical examples and it's hard to cut through the noise of the Progressive Propaganda Ministry when those who believe what the PPM and the government tell them, stick their fingers in their ears and hum real loud when we TRY to have a conversation.  So as far as I'm and large the soap box is now useless outside of , as they say, preaching to the choir.

The Ballot Box in which we vote our conscious and try to put people in office who hold closest to our own ideals and beliefs.  Well that one is now well and truly fucked.  Anytime anyone comes out of the grass roots as it were, a reformer, they are vilified, shouted down, shouted over, etc...or the PPM digs out old skeletons as it were to destroy them. Look at what happened with the willing connivance between the PPM and the Republican National Committee  in 2011-2012 election cyclein their successful efforts to destroy every other possible candidate until we were left with Romney...the RNC's chosen man, chosen I might add before the first goddamn debate was even over.

The Jury Box- in which we chosen for a jury are supposed to decide whether we believe someone guilty of a crime solely on evidence, not emotion.  You can feel in your heart that a defendant is as guilty as sin, but if you decide the case on that,  on feeling. on facts not in evidence you fail your duty as a juror, and better pray to whatever god you believe in that  you don't face the same dishonesty in your jurors should you face a judge and jury someday. IOW should the shoe be on the other foot.  I don't care if the son of a bitch on trial has a record as long as my arm that includes rape, robbery and all sorts of other fun and entertaining criminal discord...the fact he's out is either a failure on the part of cops to find actual evidence, the prosecution to prove it's case or the system itself for failing us all. Make  no mistake the justice system is failing us miserably.  It's also still having some successes and actually doing it's job.  I could keep on in this vein and give examples and what I believe is a huge travesty of justice in keeping someone alive whose such a danger to the populace that we keep him in a cage indefinitely at tax payer expense, and it's expensive. [it runs in the BILLIONS to house a states prisoners every year.] rather than removing him from the equation of life. However that is an issue that includes my take on the death penalty and that discussion is NOT why we're here right this second.

 Finally there is the final arbiter...the ammo box. In which the only way to be free because the other 3 boxes have to start the bullets flying and people on both sides start dying.  Frankly as heated and nasty as the arguments are getting, as we have more and more examples of a government run amok...we may very well be approaching that time.  Our forefathers guaranteed us and protected this final box in the Constitution because they knew as students of history, that all governments eventually slide over that embankment of power onto the road of  tyranny eventually. They knew that a free, educated and armed populace could not be enslaved without a fight, or deceit and  trickery.

Can we who believe in the Constitution and the greatness of our nation turn back the tide of tyranny using solely the 1st 3 boxes before it's too late, and have no choice but to open the fourth?
 I don't know what to think on that score anymore.  Somedays I say unequivocally "yes" and then I read shit like this court opinion, see honest people vilified and verbally stone for their honesty and forthrightness and  belief in the greatness of the nation, the law and the people. I've said before I've been blocked from and by more groups than I care to think about. Most of them are a mental masturbatory circle jerk echo chamber. Some started out that way...some get taken over by the idiots and become that way and.......sigh and this is turning into one long assed ramble in the end. Time to end it.  I leave you to think your own thoughts and come to your own conclusions.

Woman who didn't want gun in home, now grateful she did

Oh and a hearty hat tip to my friend Miguel over at GunFreeZone for this one.

So this lady didn't want a gun but her husband insisted she learn how to use one just in case.  Turns out the hubby was right.  As some of my friends in the gun community are fond of saying "It's better to have a gun and not need it, then to need it and not have it."

Turns out that the idiots who broke into her home were brothers and they were high on some illicit substance. Do any of the anti gun nuggets out there REALLY think talking or tossing something at them would have worked?  If so..more the fool you.

Well as some of you may know George Zimmerman's wife called the cops and accused him of assault and pointing a gun at her.

Now he was released and in a simply shocking  turn of events..SHE has been arrested.

Now does anyone notice a difference in the two links?

If you guessed that the link about George is from a NATIONAL Big 3[ABC/CBS/NBC] affiliate and the other is a smaller outlet.  Congratulations! You grok*. If you didn't guess the correct answer...well there's always the next pop quiz I suppose.

The first got splattered all over the national news, non stop. While the second, outside of 2 smaller outlets is getting no play  whatsoever in the national media. Hell even FOX ain't bothered to report the 2nd one yet and I figured they'd be first to jump on it.

In other news Shellie Zimmerman was pled guilty to and took  a plea deal for perjury, about 2weeks ago. A friend of mine suggested that from his read of it, she was railroaded. That may or may not be...but did not the STATE government of Florida, and the progressive propaganda ministry ,and that quisling ass licking, duck fucking, dipshit we have for a President;  do that to her husband from the get go?   Is she not trying to do the same thing now to get a more favorable outcome for her in the divorce case against her soon to be EX husband?  Welcome to the party Shellie, karma is a bitch.

Hmmm if the video from Shellie's ipad show that she did in fact start the altercation with George the other day and was the one doing the assaulting?  I wonder what the fact that she's already on probation for lying, is going to do to any sentences she might garner if tried  and convicted by judge or jury for this assault charge?   For one it certainly violates the terms of her probation, so she'll likely get time behind bars for that alone.  We'll just have to watch and see.

As I sit here on this beautiful friday afternoon, miserable, I gotta ask?  What for did I do to deserves this misery?

Oh yeah..I skipped out on taking my allergy meds for a day or two in the middle of ragweed season. this is my punishment.  My sinuses telling me in totally not subtle, totally unequivocal way that *I* am a dumb ass for not taking my allergy meds.

With any luck I'll be better by tomorrow. Sunday at the latest. in the mean time...I am miserable.

9/11...12 years later.

Yay and verily it's that time of year again. Time to shout "Remember 9/11", and ask "where were you/what were you doing on that day"

I'll keep this short and sweet folks.
I remember EXACTLY where I was and exactly what I was doing when it happened.  I also remember thinking as I ran over to the electronics department just in time to watch the plane fly into the 2nd tower.."someone just declared war".  I also remember thinking it might have been the Pakistanis.    Honestly as hypocritical as this is going to sound. I don't need people posting "remember 9/11" across my wall. I said. I remember exactly where I was and what I was doing.
I also have something like 15-20 VHS tapes full of non stop hour by hour, 24hr coverage for days afterword. For days afterword my VCR was NEVER off and neither was my television. If the tape ran out when I was home..I changed it. If it was set to run out in the middle of the night..I set my alarm clock for a little before  that time to change the tape. While I was at work my little sister did it for me. I did that for...4 days. I called my sister shortly after I watched the plane hit the 2nd tower and told her to jack a blank into the VCR and hit record.  I bought a pack of tapes during my lunch break and took it home with  me.

I will never forget. I will never forgive.  Ever.

addendum 9/11/13 1:50pm:
Then there was the US Ambassador and 3 other brave souls killed by yet more cowards on the anniversary of 9/11, on september 11th 2012.  What did our government do about it? They blamed it on you tube video. Said it had nothing to do with the anniversary of 9/11 and swept it under the rug with the willing perfidity and compliance of the Progressive Propaganda Ministry.

Again..I will never forget and I will never forgive. In this case that extends to the people who killed our ambassador and his security team AND to our government.

Race? what is race?

Good question.
Here's the short answer. It's a massive crockpot full of shit on high temp that's stinking up the whole house  and a misnomer.

"Wait? What?"  I can here you say or in some cases shout at the top of your lungs.

Verily, calm down. Sit a bit and ruminate, whilst I illuminate. Yes as a matter of fact I've happily jacked that line from a Disney cartoon. What of it? It's a good line. Movie was full of 'em. However I digress, back to the subject at hand.

Race, is a massive crock of shit. A false bill of goods. Snake oil sold to the unwitting and in some cases the willfully ignorant,  by a nest of snakes.  A great many of them in political office.  Lets not get me started on what I'd like to do to most politicians. It's graphic and ugly.

What most people refer to as "race" is in point of fact, my fellow germs and virii..Tribe.  Ergo 'racism' is 'tribalism'.  In other words, differences of opinion and fighting between the various tribes of man.   There are as many different tribes and kinds of tribes as...well I won't say as there's stars in the sky, or fish in the sea because that would be an exaggeration. However there's a just a whole lot of different tribes and kinds of tribes out there in the world of man.

Tribalism has existed among man since we first separated from our ape ancestors and came down out of the trees.  Sociologically it all breaks down to tribe in one form or another.
In the micro scale you see it as loyalty and relationship of  family. Blood relations.  Your mother, your father, your sisters and brothers.  Next scale up is extended family, Aunts, uncles, cousins etc. 
In times past to make or preserve peace or for varying other family would marry into another by bonding their sons and daughters. Thereby making, keeping the peace, cementing ties of friendship and power...the reasons for marriage are varied throughout history and that's a whole different discussion on it's own.  

Here's another example of tribe. The social tribes.  Folks who get together for love or enjoyment of one form of art, or what they consider art or another. Love of machines like cars.  Enjoyment in collecting something like guns, knives, books, musical instruments etc etc ad nauseum.   Sports fans are another tribe, choosing to belong to a tribe that share's their love and enjoyment of a game. Cosplayers, Gamers, Geeks, all different tribes with one thing in common. Their love of and enjoyment in sharing what they love with others who feel as they do.  They are tribes of choice. They  choose to belong to that tribe.

What else are the military branches but tribes. Navy, Marines, Army, Air Force etc.  Tribes that give up something, time, some freedoms and time for themselves for their  the smaller tribe, their family to join a larger tribe, the military as a whole, in order to serve the greater good for an even GREATER tribe.   In other words their nation.  They sacrifice some of the smaller tribal needs for the needs of the greater tribe, the nation. 

Nation or nationality is tribalism in Macro or large scale...simplest way I can put it.

Tribes all have varying desires, wants, needs and are GOING to clash. It's just nature.  all nature wars on itself. Plants will strive to grow faster, grow off to the side or even strangle their competitors for sunlight to grow. Small fish are hunted and eaten by other fish, who in turn are hunted by something else right on up the chain.  Insects war among each other for territory and sustenance and supplies for the larder, for the good of that insect tribe.
There isn't but one race, the human race, all else is tribalism.  Once you accept that...[or happen to have a low tolerance for bullshit from the get go] it's a little easier to deal with the "race baiters", and those who cry "racism, racist, hater...etc etc.".  They are in it not to better their tribe but for the betterment of themselves at the EXPENSE of their tribe and everyone else.     It's also a lot of fun to make their heads explode when you explain this stuff to them.  the apoplexy, oh my god the faces turned purple with down right amusing.  I keep waiting for their heads to explode in the most literal sense of the word, from blood pressure alone, but I keep getting disappointed. Oh well. I can live with that I suppose.

Another sign we're doomed.

A friend of mine on facebook, sweet lady, went to purchase a brand new car today.  They required the names and telephone numbers of 3 people, one of whom could not live at the same address.   When she asked why, she was told...because they had to run the names by DHS to make sure they weren't on some watch list or another.  She said they spent quite a bit of time waiting and wonders how much of that was waiting for DHS to come back with an answer.  Yes apparently such a requirement exists.  It was a part of the Patriot Act signed by Bush the 2nd. It's called the International Money Laundering Abatement and Anti Terrorist Financing Act.

The laws enacted are collectively identified as the Customer Identification Programs for Financial Transactions.

Used to be you had to do a credit check, if your credit was good the banks financed you. If not they either wouldn't, period dot, or wouldn't without a co signer and a decent down payment.

Now you gotta give 3 names and phone number and be run by DHS to see if you are on a watch list?
The terrorists and the those intent on grabbing power for power's sake in this country....have won the last several rounds.   I just don't know folks

10 more days.

10 more days until the 12th anniversary of yet another day in US History that will live in infamy.

I'll be doing my usual post on that day. Meanwhile...our government is playing politics, our president is thinking about getting us involved in another one of those "police actions" like they called a limited way. Getting us involved in yet another country's civil war. A hole in the wall, a hot, sandy, steaming pile of shit called Syria. For what? For the very bio chem weapons that the libs screamed that Bush lied about Saddam having. Sigh. Intelligence reports some of the info from which was released by Bush 2 at the time, stated that before the invasion got underway that Saddam sent his bio chem shit to Syria and planes and other equipment elsewhere.  So what's so fucking shocking about Syria's government using those same chemical weapons on it's own country NOW, much like Saddam did to the kurds?

Sigh...and the saga continues.
